By accessing or using the services provided by shantyhgjk B.V. ("shantyhgjk," "we," "our," or "us"), including visiting our thermal spa and sauna complex, booking treatments, or using our website at shantyhgjk.top, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use our services. These Terms constitute a legally binding agreement between you and shantyhgjk B.V., a company registered in the Netherlands under registration number N22356256.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

• Related amenities and facilities

User Obligations and Conduct

By using our services, you agree to:

• Provide accurate and complete information when booking services
• Follow all facility rules and staff instructions
• Respect other guests and maintain appropriate behaviour
• Disclose any health conditions that may affect your use of our facilities
• Arrive punctually for scheduled appointments
• Pay all fees and charges in accordance with our pricing

You agree not to:

• Use our facilities while under the influence of alcohol or drugs
• Engage in disruptive, inappropriate, or unsafe behaviour
• Bring prohibited items into the facility
• Use mobile devices or cameras in designated private areas
• Violate any applicable laws or regulations

Booking and Payment Terms

Reservations

All bookings are subject to availability and confirmation by shantyhgjk. We reserve the right to refuse service or cancel bookings at our discretion. Advance booking is recommended and may be required for certain services.

Payment

Payment is required at the time of service or as specified in advance booking confirmations. We accept major credit cards, debit cards, and other payment methods as displayed at our facility. All prices are in Euros and include applicable VAT.

Cancellation Policy

Cancellations must be made at least 24 hours in advance to avoid charges. Late cancellations or no-shows may be subject to fees equivalent to the full service cost. We may waive fees in exceptional circumstances at our discretion.

Health and Safety

Your health and safety are paramount. You acknowledge and agree that:

• You use our facilities and services at your own risk
• You will disclose any health conditions, injuries, or medications that may affect your safety
• You will follow all posted safety guidelines and staff instructions

• Proprietary treatment methods and wellness programs
• Marketing materials and promotional content
• Facility design and layout concepts

You may not use, reproduce, distribute, or create derivative works from any of our intellectual property without explicit written permission from shantyhgjk.

Privacy and Data Protection

Limitation of Liability

Our total liability to you for all claims arising out of or relating to these Terms or our services shall not exceed the amount you paid to shantyhgjk for the specific service giving rise to the claim during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we strive to provide high-quality services and maintain our facilities to the highest standards, we do not warrant that:

• Our services will meet your specific requirements or expectations
• Our services will be uninterrupted, timely, secure, or error-free
• Any particular results or benefits will be achieved
• All defects or issues will be corrected immediately

Indemnification

You agree to defend, indemnify, and hold harmless shantyhgjk, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms, violation of facility rules, or behaviour that endangers the safety or enjoyment of other guests.

You may terminate your relationship with shantyhgjk at any time by discontinuing use of our services. However, cancellation policies for specific bookings or memberships will continue to apply.

Upon termination, your right to use our services will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Force Majeure

shantyhgjk shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government actions, or public health emergencies. In such events, we will make reasonable efforts to notify affected customers and provide alternative arrangements where possible.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of the Netherlands, and you hereby consent to personal jurisdiction and venue therein.

If you are a consumer residing in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired. In such cases, the invalid provision will be replaced with a valid provision that most closely reflects the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and shantyhgjk regarding the use of our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
